1. Acceptance of Terms

By accessing or using Defynr™, CereBro™, or VideoBro™ (“Services”), you agree to these Terms. The Services are intended for personal athletic use only.

2. Nature of the Service

Defynr is a software platform for performance guidance, not a healthcare provider.

All outputs (including training plans, recovery insights, and physiological analysis):

• ✓ are informational only
• ✓ do not constitute medical advice
• ✓ should not replace professional consultation

You are solely responsible for how you use the Services.

3. Medical Disclaimer

You should consult a qualified medical professional before:

• ✓ starting or modifying training programs
• ✓ acting on physiological insights
• ✓ engaging in high-intensity endurance activities

Defynr assumes no responsibility for injuries, health complications, or training outcomes.

4. Beta Program Terms (if applicable)

During early access or beta phases:

• ✓ features may change without notice
• ✓ integrations (e.g., Garmin and other supported providers) may be unstable or unavailable
• ✓ outputs may evolve as models improve

Defynr does not guarantee accuracy, uptime, or performance outcomes.

5. User Responsibilities

You agree not to falsify or manipulate activity or device data, reverse engineer or probe system logic, or misuse APIs or attempt unauthorized access. Violations may result in suspension, termination, or revocation of access.

6. Intellectual Property

All platform components, including algorithms, training frameworks, AI-generated outputs, and UX systems are proprietary to Defynr.

“Defynr™”, “CereBro™”, and “VideoBro™” are trademarks of Defynr (pre-incorporation).

7. Data Handling & Retention

Your data is handled in accordance with our Privacy Policy.

Account Deletion

When you delete your account, all personally identifiable information (PII) is permanently removed or irreversibly detached from your data.

30-Day Grace Period

Your account may be recoverable within 30 days.

Post-Deletion Processing

After this period, all identifiable user data is permanently deleted. Certain activity and performance data may be retained only in a fully anonymized and non-identifiable form.

Anonymized Data Usage

Such anonymized data may be used for system improvement, aggregated insights, or model development. This data cannot be linked back to any individual, does not contain personal identifiers, and is processed in accordance with applicable data protection laws.

No Re-Identification

Defynr does not attempt to re-identify anonymized data.

8. Service Availability

We do not guarantee uninterrupted access, availability of third-party integrations, or completeness or accuracy of data.

9. Limitation of Liability

To the maximum extent permitted by law, Defynr shall not be liable for indirect or consequential damages, training outcomes or performance loss, inaccuracies in data or recommendations, or missed events or disruptions. Use of the Services is at your own risk.

10. Termination

We may suspend or terminate access if these Terms are violated, misuse is detected, or system integrity is at risk.

11. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the applicable arbitration framework within the relevant jurisdiction of incorporation.

12. Changes to Terms

We may update these Terms periodically. Continued use of the Services constitutes acceptance of the updated Terms.
